New York is an equitable division state, which means that all marital property/assets are divided equitably. Equitable division of assets means that all marital property (assets and debt acquired during the marriage) are distributed “fairly.” Examples of marital property include:

  • Savings accounts;
  • Retirement accounts;
  • Real estate;
  • Stocks and bonds;
  • Vehicles; and
  • Furniture and household appliances.

Spousal Support

Spousal support (alimony) is paid to the lower-earning spouse as part of many divorce agreements. Typically, when spousal support is awarded, one spouse made non-financial contributions to the marriage—such as home-making, child-raising, or supporting the other spouse in their career or education—and these contributions are reciprocated via monthly or lump-sum financial payments after or during divorce.

Child Custody

Child custody is often the hardest aspect of divorce or separation. Each parent believes in their own ability to care for their child, which is only natural. Yet, if parents cannot make a child custody decision by themselves, mediation (possibly followed by a child custody hearing) becomes necessary.

Child Support

Child support is a financial tool used to support one’s child, and is paid by the non-custodial parent to the custodial parent. No matter what party you represent yourself, we can help you achieve the goals you have set out for yourself and your child.

Post-Divorce Modifications

Many aspects of divorce can be modified afterwards when circumstances have changed. As such, if you are not happy with the child custody agreement created a year ago, it is within your rights to pursue a modification. The same goes for child support and spousal support.
